PEPnet and Kudos Boards Consent Statement (Global)

Your use of PEPnet and Kudos Boards mobile application (the "App") is voluntary. Personal information processed in connection with PEPnet and Kudos Boards will be used as described in the PEPnet and Kudos Boards Privacy Policy included on the home page of this App. You will be able to access and view your personal information from your MyPepsiCo Profile, as further described in the PEPnet and Kudos Boards Privacy Policy.

Terms of Use (Global)

Introduction

These Terms of Use establish standards for appropriate use of PepsiCo's PEPnet and Kudos Boards system, services, electronic tools, information assets and electronic network ("PEPnet and Kudos Boards"). The Terms of Use, together with the PEPnet and Kudos Boards Privacy Policy, apply to users of PEPnet and Kudos Boards("Users"). PEPnet and Kudos Boards, including all of its component features (e.g., electronic communities, blogs, wikis, forums, networks, electronic mail,applications), is a PepsiCo asset that is provided for use only by authorized Users for legitimate business purposes.

Any use of PEPnet and Kudos Boards that is illegal, harassing, offensive, detrimental to PepsiCo, or in violation of PepsiCo's Code of Conduct or other applicable PepsiCo policies, standards, or guidelines, is a violation of these Terms of Use.

Acceptance of Terms

Use of PEPnet and Kudos Boards signifies that the User agrees to these Terms of Use. Users are responsible for understanding and complying with these Terms of Use.

Subject to applicable law, unauthorized use of PEPnet and Kudos Boards may lead to disciplinary action up to and including termination, as well as legal action. By using PEPnet and Kudos Boards, the User represents that he or she is an authorized User and agrees to comply with these Terms of Use and all other applicable PepsiCo policies.

Monitoring and Expectation of Privacy

In accordance with applicable law, PepsiCo may monitor, review or otherwise process any files, messages, communications or other information stored, created, sent, received, viewed or accessed on or using PEPnet and Kudos Boards ("Materials").

Users in the European Economic Area (and in other countries outside the United States to the extent required by law) should have a limited expectation of privacy when using PEPnet and Kudos Boards, or in any Materials.

Users in the United States (and in other countries outside the European Economic Area to the extent permitted by law) should have no expectation of privacy when using PEPnet and Kudos Boards, or in any Materials, regardless of (1) the purpose of the use, (2) the content of the Materials, (3) any access permissions,(4) whether the Materials have been deleted, or (5) any other factor. These users are advised to not use PEPnet and Kudos Boards for any Materials they wish to keep private.

Misuse Reporting

Users must immediately report to PEPSICOLLABORATION@PEPSICO.COM any (1) information security incident involving PEPnet and Kudos Boards(including, but not limited to, access by an unauthorized party), or (2) any other actual or suspected misuse of PEPnet and Kudos Boards.

Acceptable Use of PEPnet and Kudos Boards

  • Under no circumstances is any User authorized to engage in any illegal activity while using PEPnet and Kudos Boards.
  • Users are responsible for using PEPnet and Kudos Boards professionally, ethically and lawfully, and shall be accountable for all activity associated with their PEPnet and Kudos Boards accounts. Users may not share authentication credentials or passwords with anyone.
  • PEPnet and Kudos Boards shall be used for authorized PepsiCo business in accordance with applicable laws and regulations.
  • In general, minimal, infrequent and brief personal use of PEPnet and Kudos Boards is permitted, provided that such use does not (1) interfere with the User's work performance or fulfillment of contractual obligations; (2) interfere with other User's work performance or fulfillment of contractual obligations; (3) have an adverse effect on the operation of PEPnet and Kudos Boards; (4) result in any material expense to PepsiCo; (5) violate any law or regulation of any jurisdiction; or (6) violate any other provision of PepsiCo's Code of Conduct or other PepsiCo policies, standards, or guidelines.
  • Information created, accessed, transmitted or stored using PEPnet and Kudos Boards that must be preserved for regulatory, legal, fiscal or business purposes must be retained in accordance with the PepsiCo Records Management Policy.
  • PEPnet and Kudos Boards may be used only with PepsiCo-approved Internet browser software versions and security configurations.
  • PEPnet and Kudos Boards shall not be used for the following:
    • Activity that is illegal, unethical or improper
    • Activity that is deceptive or fraudulent
    • Activity that interferes with normal business operations
    • Activity that violates PepsiCo's Code of Conduct or policies
    • Activity that interferes with work performance
  • PEPnet and Kudos Boards shall not be used for accessing, transmitting, receiving, printing, or storing any image, graphic, document, text, or other material that may be construed as harassing, derogatory, obscene, controversial, inflammatory, hateful, discriminating, or offensive to others with respect to race, national origin, color, gender, sexual orientation, age, disability, veteran status, marital status, or religious or political beliefs.
  • PEPnet and Kudos Boards shall not be used in a manner that is libelous or defamatory, or otherwise threatening, intimidating, abusive, violent, harassing, humiliating, embarrassing, disparaging, malicious or harmful to any person or entity, or invasive of another's privacy.
  • Users must refrain from making false or misleading statements on PEPnet and Kudos Boards and should take the initiative to correct their own mistakes.
  • PEPnet and Kudos Boards shall not be used to knowingly disable or overload any system or network, or to circumvent (1) any system intended to protect the security of PepsiCo information, or (2) authentication protocols or security measures of any host, network, account, or third party proprietary protection.
  • PEPnet and Kudos Boards shall not be used for dissemination of sensitive information.
  • In accordance with applicable law and PepsiCo policies, Users shall protect and maintain the confidentiality of all personal information created, accessed, transmitted or stored using PEPnet and Kudos Boards.
  • PEPnet and Kudos Boards shall not be used to deliberately perform acts that waste computer resources or unfairly monopolize resources (e.g., sending mass mailings or chain letters, engaging in chat groups, playing games, downloading very large files).
  • PEPnet and Kudos Boards shall not be used for solicitations, advertisements, or conducting commerce unrelated to PepsiCo business.
  • PEPnet and Kudos Boards shall not be used to access external web-based electronic mail services.
  • PEPnet and Kudos Boards shall not be used to violate the rights of any person or company protected by privacy and data protection rights, copyright, trade secret, patent or other intellectual property or similar applicable laws or regulations.
  • PEPnet and Kudos Boards shall not be used to (1) transfer copyrighted material including, but not limited to, digitization and distribution of photographs from magazines, books or other copyrighted sources, copyrighted music, or copyrighted software for which PepsiCo or the User does not have an active license; or (2) upload, download, install send, receive, or store software (e.g., freeware, shareware), or data (e.g., games, music, applications).
  • PEPnet and Kudos Boards shall not be used to participate in activities on external websites.

Reporting Hours Worked (non-exempt employees only)

You understand that performing off-shift work using the App is prohibited and that you must obtain express approval from your manager prior to using any the App for work outside your normal work hours or during your meal break.

You understand that you are responsible for reporting all time worked, including time that you spend working on mobile devices and technologies, even if outside normal work hours.

You understand that you are required to report all time worked if you engage in any of these activities, even without prior written approval from your manager. You further understand that you will be paid for such time worked, but that you may be subject to discipline for such unauthorized work.


Your personal information will be shared with PepsiCo entities and employees in other countries, including countries where the laws may not offer the same level of data protection as the laws in your own country.
